Who is the controller of your personal data?

The Dutch companies Wikkelhouse B.V. and Fiction Factory B.V. (Back-upstraat 1,1033NX Amsterdam, The Netherlands) are joint controllers of the personal data you submit to us and therefor responsible for your personal data under applicable data protection law.

Where & how long do we store your data?

The data that we collect from you is stored within the European Economic Area (“EEA”).

The data is stored for as long as it is necessary to achieve the purposes for which your data is collected (i.e. to provide you the services).

Who can access your data?

Your data may be shared within the companies Wikkelhouse B.V. and Fiction Factory B.V. (for more information about these companies we refer to wikkelhouse.com and fictionfactory.nl), hereinafter referred to as “we” and “us”. 

To provide the services to you, your data may be shared with third parties service providers. These service providers process your data on our behalf and we enter into data processing agreements with them to safeguard the level of security of your data.

Of course, we never pass on, sell or swap your data for marketing purposes to third parties (nor for any other reason than for which you have provided the data to us). 

What data is collected?

By using our website and the services of our Webshop, we process your personal data. An overview of the personal data we process:

  • Name (first & last)
  • Address / Contact details
  • Email address
  • Payment details
  • Phone number
  • Surf / clicking behaviour on our website.
  • Internet Browser / IP address and device type, for proper communication between our webshop and your device.

What is the legal ground and purpose(s) for processing?

The processing of your data is necessary for the performance of a contract (in connection with purchases in our Webshop) and based on our legitimate interests, namely to provide customer service, be able to inform you and reply to information requests, and to send you newsletters and other direct marketing. Note that you can opt-out at any time if you do not wish to receive newsletters anymore.

The purposes of collecting and processing your data is:

  • the settlement of purchase(s), deliveries and payment on the webshop;
  • providing customer support in relation to the purchase(s), returns etc.;
  • reply to information requests;
  • providing information regarding our services and sending online offers/ news letters;
  • analysis of (surf/ clicking) behavior to improve our webshop.

For every specific process of personal data we collect from you, we will inform you whether it is an obligation to provide the personal data and possible consequences if you choose not to.

We do not make decisions solely based on automated decision-making.

What are your rights?

Right to access: You have the right to request information about the personal data we hold on you at any time. You can contact us per email in case of any requests regarding this.

Right to portability: Whenever we process your personal data, by means based on your consent or based on an agreement, you have the right to get a copy of your data transferred to you or to another party. This only includes the personal data you have submitted to us.

Right to rectification: You have the right to request rectification of your personal data if the information is incorrect, including the right to have incomplete personal data completed.

Right to erasure: You have the right to erase any personal data processed by us at any time except for the following situations:

  • you have an ongoing matter with Wikkelhouse B.V. and / or Fiction Factory B.V.
  • you have an open order which has not yet been shipped or partially shipped
  • you have an unsettled debt with Wikkelhouse B.V. and / or Fiction Factory B.V., regardless of the payment method
  • if you are suspected or have misused our services within the last four years
  • if you have made any purchase: We will keep your personal data in connection to your transaction for book-keeping purposes.

Your right to object to processing based on legitimate interest: You have the right to object to processing of your personal data that is based on  legitimate interest.

Your right to object to direct marketing: You have the right to object to direct marketing, including profiling analysis made for direct marketing purposes. You can opt out from direct marketing by following the instructions in any marketing e-mailing.

Right to restriction: You have the right to request that we restrict the process of your personal data under the following circumstances:

  • if you object to a processing based on our legitimate interest, we shall restrict all processing of such data pending the verification of the legitimate interest.
  • if you have claim that your personal data is incorrect, we must restrict all processing of such data pending the verification of the accuracy of the personal data.
  • if the processing is unlawful you can oppose the erasure of personal data and instead request the restriction of the use of your personal data instead.

How can you exercise your rights?

Right to complain with a supervisory authority: 

If you consider Wikkelhouse B.V. and / or Fiction Factory B.V. to process your personal data in an incorrect way you can contact us. You also have the right to raise a complaint to a supervisory authority.
